Gustavo is your AI-powered nutrition companion. Photograph any dish or restaurant menu and get instant calorie and macro estimates. Correct any detail with a tap and Gustavo recalculates on the fly. Scan a menu to choose your order consciously, or tell Gustavo what's in your pantry and get a recipe with what you already have. Track your daily meals and reach your goals — without feeling restricted.

These Terms of Service ("Terms") govern your use of the Gustavo iOS application ("the App"), developed and maintained by Francesco Sarpellon, operating as LoopSpark Studio ("we", "us", "our"). By downloading or using the App, you agree to these Terms.

The Service

Gustavo is an AI-powered nutritional analysis application that uses the Google Gemini API to estimate the nutritional content of dishes and menus from photos. The App is available in a free (ad-supported) version and a paid subscription version.

Nutritional estimates provided by the App are generated by artificial intelligence and are approximations. They are intended for general informational purposes only and may not reflect the exact nutritional content of any specific dish or ingredient. Always consult a qualified health professional or registered dietitian for personalised dietary advice.

Eligibility

Gustavo is rated 9+ on the App Store. By using the App, you confirm that you have sufficient age and maturity to use a nutrition-tracking application, or that you have the consent of a parent or legal guardian. The App is not directed at young children.

Subscriptions and Payments

Gustavo offers optional paid subscriptions that remove advertising and unlock additional features:

• Weekly subscription — billed weekly via your Apple ID.
• Monthly subscription — billed monthly via your Apple ID.

All payments are processed by Apple through the App Store. We do not collect or store your payment information. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your iPhone Settings under your Apple ID → Subscriptions.

Prices may vary by country and are subject to change. We will notify users of price changes in advance where required by applicable law.

Refunds are handled exclusively by Apple in accordance with their refund policy. We have no ability to issue refunds directly.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:

• Use the App for any unlawful or fraudulent purpose.
• Attempt to reverse-engineer, decompile, or modify the App.
• Interfere with or disrupt the App's infrastructure or servers.
• Use the App in any way that could damage, disable, or impair its functionality.
• Attempt to bypass the subscription system or access paid features without payment.

Intellectual Property

All content, design, code, and intellectual property in the App are owned by Francesco Sarpellon / LoopSpark Studio or licensed to us. You may not reproduce, distribute, or create derivative works based on the App or its content without our express written permission.

Content you create within the App (diary entries, personal notes) remains yours. We claim no ownership over your personal data.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be error-free or uninterrupted.
• Nutritional estimates will be accurate or complete.
• The App will meet your specific health or dietary requirements.

Use of the App for health decisions is at your own risk. Always seek professional medical or nutritional advice before making significant changes to your diet.

Limitation of Liability

To the maximum extent permitted by applicable law, Francesco Sarpellon / LoopSpark Studio shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to health decisions made based on the App's estimates.

Our total liability to you for any claim arising from your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

Third-Party Services

The App integrates with third-party services including Google Gemini API, Google AdMob, Apple HealthKit, and Apple StoreKit. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third-party providers.

Termination

We reserve the right to suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time by deleting it from your device. Active subscriptions must be cancelled separately via Apple Settings.

Governing Law

These Terms are governed by the laws of Italy. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Italy, without prejudice to your rights as a consumer under applicable European Union law.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
